Mesidor PLLC Files Arbitration Demand Against Morgan Stanley Alleging Workplace Discrimination and Retaliation

New York, NY — May 11, 2026 — Mesidor PLLC, a leading plaintiff-side employment law firm dedicated to combating workplace discrimination and harassment, issued the following statement regarding the recent dismissal of Waiguchu v. Morgan Stanley & Co. LLC, originally filed in the United States District Court for the Southern District of New York (Docket No. 25-CV-7443).

While the Court dismissed the case on the narrow procedural issue of whether the matter belongs in court or arbitration, the firm emphasizes that this decision does not address the merits of Ms. Waiguchu’s claims.

Ms. Theresa Waiguchu, current Vice President at Morgan Stanley, alleges that she was subjected to a pattern of discrimination, retaliation, and failure to accommodate her disability during her employment. The complaint details allegations of race, gender, and disability discrimination, as well as retaliation for reporting misconduct and exercising her legal rights.

According to the complaint, Ms. Waiguchu experienced ongoing workplace hostility, including discriminatory treatment by supervisors, retaliation following internal complaints, and adverse employment actions tied to her use of protected leave and accommodation requests.

Mesidor PLLC confirms that the case will now proceed in arbitration, where the firm intends to continue aggressively advocating on behalf of Ms. Waiguchu.
